§ 1 General Shipping Conditions
(1) Deliveries are made worldwide ex warehouse or via appointed logistics, freight forwarding, or specialized transport providers to the delivery address specified by the customer.
(2) The selection of the carrier, transport route, and shipping method is made exclusively by Mathies Schiffsausrüster SAS at its sole professional discretion, taking into account operational, logistical, and safety-related requirements.
(3) The customer has no entitlement to any specific shipping method, transport route, or logistics provider.
§ 2 Delivery Times
(1) Delivery times are non-binding estimates unless expressly confirmed in writing as binding.
(2) Delivery periods commence only after full payment has been received and all commercial and operational checks have been completed.
(3) Standard delivery times:
• Within Europe (EU): 2–7 working days
• International (outside the EU): 5–14 working days
(4) For specific product categories, including but not limited to oversized goods, technical heavy equipment, safety-related items, or regulated dangerous goods, delivery times may extend up to 21 working days.
(5) Delays caused by customs clearance, transport restrictions, governmental measures, or any circumstances beyond the Seller’s control remain reserved.
§ 3 Freight Forwarding and Special Shipments
(1) Certain goods are shipped exclusively via freight forwarders or specialized logistics providers.
(2) This applies in particular to:
• life-saving and safety equipment (e.g. life rafts)
• marine engines, propulsion systems, and heavy technical assemblies
• pyrotechnic safety and signalling devices (e.g. distress flares)
• dangerous goods within the meaning of applicable transport regulations
• oversized, heavy, or high-volume industrial goods
• maritime, offshore, and shipyard-related equipment
(3) Transport is carried out exclusively by duly licensed and qualified carriers in compliance with all applicable legal and regulatory requirements.
§ 4 Shipping Costs
(1) Shipping costs are calculated individually based on destination, weight, volume, transport method, and any special handling requirements.
(2) Binding shipping costs are communicated during the ordering process or at the latest in the order confirmation.
§ 5 Customs, Import Duties and Taxes
(1) International deliveries may be subject to customs duties, import taxes, and other local charges.
(2) Such charges are not included in the purchase price and are borne exclusively by the customer.
§ 6 Shipping Information and Tracking
(1) Shipping information, status updates, tracking data, or any comparable information do not form part of the contractual obligations.
(2) There is no obligation on the Seller to provide tracking or shipment status information.
(3) Logistics processes are carried out via different freight and transport systems where end-to-end shipment tracking is not part of the standard service.
§ 7 Partial Deliveries
(1) Partial deliveries are permitted insofar as they are reasonable for the customer and do not conflict with the contractual purpose.
(2) No additional shipping costs arise from partial deliveries unless expressly agreed otherwise.
§ 8 Transfer of Risk
(1) For business customers, the risk of accidental loss or deterioration of the goods passes to the customer upon handover of the goods to the carrier.
§ 9 Non-Delivery
(1) If delivery cannot be completed due to reasons within the customer’s responsibility (including incorrect address details, missing import clearances, or refusal of acceptance), the customer shall bear all resulting additional costs.
§ 10 Force Majeure
(1) Force majeure events release the parties from their contractual obligations for the duration of the disruption.
(2) Such events include in particular natural disasters, war, governmental actions, strikes, supply chain disruptions, energy shortages, and disruptions of international transport and logistics systems.
(3) Delivery periods shall be extended appropriately for the duration of the disruption.
